120-day foreclosure “stay” in Sandusky

FYI- Judge Roger E. Binette of the Erie County Common Pleas Court has placed all foreclosure suits on a 120-day “stay” beginning April 15. He was quoted as stating “my court will set foreclosure cases for a Settlement/Case Management Conference (“CMC”). At the CMC, the financial institution or note holder and the debtor will be required to ascertain whether, in good faith, a resolution can be reached.”

Update: I haven’t been able to find anything else about this, though it’s week-old news. From the story summary at the link, it’s clear that Judge Binette sees the four-month stay of foreclosure cases as a way of encouraging pre-trial settlements, connected in some way with the Supreme Court’s mediation initiative. But does it apply to foreclosures already before the Court, or only new cases? Stay tuned.
